Software Terms of Use

Article 1 Purpose of these Terms

These Terms of Use (hereinafter referred to as the "Terms") set forth the terms of use of the software provided by ViXion Inc. (hereinafter referred to as the "Company").

Article 2 Definitions

The meanings of terms used in these Terms are as follows.

  1. Software: Firmware and firmware updater provided by our company on the condition that it is used only for this device.
  2. This device: ViXion01 sold by our company to which this software is provided

Article 3 License of use

Based on the terms of this Agreement, the Company grants the User a non-exclusive right to use the Software.

Article 4 Attribution of rights

Article 5 Prohibited matters

Article 6 Software version upgrade
  1. The Company may update the Software without prior notice to the User. However, our company is not obligated to update the software under any circumstances.
  2. If this software is updated, the user may use the updated version of this service only if the user obtains separate permission from the company and in accordance with the terms of that permission and the terms of this agreement.
  3. The Company shall not be held responsible for any malfunction of this software.
Article 7 Disclaimer

THE SOFTWARE IS PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. Our company does not guarantee that this software will be free from defects, that it will be suitable for a particular purpose, that its use will not infringe on the rights of third parties, or otherwise.

Article 8 Limitation of Liability

The Company shall not be liable for any direct or indirect damages arising from or related to this software.

Article 9 Abolition of provision

In the event that any of the following items apply, the Company shall discontinue the provision of this software without incurring any compensation for damages or other obligations.

  1. If the user violates the conditions set forth in these Terms
  2. If this service cannot be provided due to force majeure such as natural disasters, infectious diseases, epidemics, etc.
Article 10 Severability

Even if any provision or part of this Agreement is determined to be invalid or unenforceable under laws and regulations, the legality, validity, or enforceability of this Agreement and other provisions or provisions shall not be affected in any way. .

Article 11 Governing law/agreed jurisdiction

These terms and conditions shall be governed by Japanese law. For any disputes regarding these Terms, the Tokyo District Court shall have the exclusive jurisdiction of the first instance.
